Sub. Submission of Documents – Jabir’s Case

Respected Sir,

Thank you very much for pursuing the matter with the Mission in Abu Dhabi, United Arab Emirates (UAE).

As detailed in the representation to Mr. Vijay Keshav Gokhale, Foreign Secretary of India, the local Emirati, schemed in collaboration with the 'Crown Prince', the de facto head of UAE, Mohammed bin Zayed Al Nahyan, who played a full-length drama of cowardice in the Petitioner’s case.

The Petitioner could convince the Judiciary of Abu Dhabi, that these policemen were acting upon the instructions of the ruling elite. The Hon. Court moved swiftly with the evidences in front of them, declared the accused is innocent and issued an investigation order against the Abu Dhabi Police. [A copy of Judgment of Legal Court of First Instance is attached as Annexure-1]

Subsequently, the full bench in Supreme Court of Abu Dhabi, UAE, sat together and heard the case at length on immediate basis and approved the Lower Court Judgment in less than two months and in continuation, awarded additional 'Orders' including to the immediate release of petitioner. [A copy of Judgment of Final by 'APEX COURT' is attached as Annexure-2]

As the case history reveals, with the malicious motive of destroying the petitioner, the Court’s repeated orders to release of the Petitioner as well as to investigate the conduct of the Police; the crimes committed by police and the reparation order etc., were frozen by the manipulators. All four expeditious Judicial Verdicts of Abu Dhabi Courts were kicked off by the ‘UAE administration’, the de facto ruler, unexecuted.

As you see the case had already been heard and decided upon by the Hon’ble Judiciary of Abu Dhabi and 4 Judgments had been issued by those Courts. During the course of hearing the Policemen were also pleaded guilty ‘of their illegal actions amounted to a conspiracy against the Petitioner.

What was left thereafter was ‘only the Execution of Court Judgments’ and give the sanctioned benefits of those Judgments to the Petitioner. This position is clear as crystal.

But instead, the Administration of UAE, deported the ‘Petitioner' to India to save face by defrauding the Verdicts of the very Judiciary of the land and the Judgment Creditor, amount to the guilty of 'Contempt of Courts'. [A copy of ‘Deportation Order’ of UAE, is attached as Annexure-3]

Ultimately, this fraudulent deportation led to the Petitioner’s character assassination, who was under investor-status in UAE with a group of business entities in the country, worth millions of investments, leaving him in a whirlpool of mental strain and physical trauma.

The Delhi High Court heard the case and verified A to Z of the rulings of the case of ‘Petitioner', and issued a ‘Mandamus Order’ to the Government of India, Ministry of External Affairs (MEA), to settle the case in 2 months with the UAE counterpart. [A copy of Judgment of High Court of Delhi, Appellate Civil Jurisdiction, is attached as Annexure-4]

The injustices and cruelties by the authorities of UAE and India, against the ‘Judgment Creditor’,  the Petitioner, remains as the most serious case of 'fraud' for the last 22 years.

The petitioner, the undersigned, remain yours in good faith,

Thanking you,

Yours truly,

Panikkaveettil K. Jabir (Petitioner).

“Decree Holders Entitled to Enjoy Fruits of the Decree Expeditiously” - Says Supreme Court of India !
A three-judge bench of the Supreme Court of India has observed that Decree Holders must enjoy the fruits of the decree obtained by them in an expeditious manner. The Bench, speaking through Justice Dave, has noted the unscrupulous tactics used by Judgment Debtors to evade the process of law and eventually frustrate the entire efforts of a Decree Holder in getting the decree executed. Demanding Justice, Truth and Court-ordered reparations
Respect Judicial decisions and uphold the rule of law.

Mindful, in particular, that a judgment debt is hanging over the Abu Dhabi Emirate, United Arab Emirates. The judgment is binding and enforceable by the court of Abu Dhabi from where the ruling came from. It should also be kept in mind that successor governments remain bound by the acts incurred by the predecessor governments. The Judgment debt of Abu Dhabi, can be eliminated or satisfied by the enforcement of judgments and legal remedies...Investors

An innovative project ‘Judgment For Sale’

"The legal instruments that a nation or government develops are aimed at dealing effectively with every crime and providing meaningful relief to victims of their circumstances. When these legal principles are ignored it would only erode the public faith and confidence in the judicial system"...A project is aimed at giving effect to Court Judgments that remains unexecuted or unsatisfied

Is the External Affairs Ministry of India above the Law?

The External Affairs Ministry, Government of India, Respondent in C.W.No.4972/97 (C.M.9144/97) was directed by High Court of Delhi, an order of mandamus to dispose of the representation submitted by petitioner within two months of the date of the Judgment. The directives contained in the judgment of Delhi High Court was dated 20-11-1997. In total negation of such a specific order of the Delhi High Court, the External Affairs Ministry, despite the lapse of 16 years of date of the judgment, demonstrates a blatant disrespect to the law of the country....Is the External Affairs Ministry of India above the Law?
